The defendant, Richard Allen Thomas, was convicted of aggravated assault and attempt to commit a felony, robbery with a deadly weapon, by a jury of his peers. The trial court found that the defendant was a standard offender and imposed the following Range I sentences: six years in the Department of Correction for the offense of aggravated assault and three years in the Department of Correction for the offense of attempt to commit a felony. The trial court ordered that the two sentences are to be served concurrently. After the trial court denied the defendants motion for a new trial, he appealed as of right to this Court pursuant to Rule 3(b), Ten. R. App. P.
